1. Scope

These General Terms and Conditions (GTC) apply to all orders placed via the online shop shop.dark-divas.com to be completed.
Any differing terms and conditions of the customer will not be recognized unless the seller expressly agrees to their validity in writing.

2. Contracting parties and conclusion of the contract

The purchase agreement is concluded with
Mag. Florian Dünser, Dark Divas Fashion ,
hereinafter referred to as "Seller".

The presentation of products in the online shop does not constitute a legally binding offer, but rather an invitation to place an order.
By clicking the "Buy now" button, the customer places a binding order for the goods contained in the shopping cart.
The order confirmation will be sent immediately after the order is submitted via email.
A contract is only concluded once the seller confirms the order via email.

3. Prices and shipping costs

All prices quoted are in Euro (EUR) .
The seller is a small business owner according to § 6 para. 1 no. 27 UStG and therefore does not charge VAT .
In addition to the product prices, shipping costs may apply, which will be clearly displayed during the ordering process.

4. Delivery and production

The production and shipping of the goods are handled by the print-on-demand service provider Printful, which is based in the EU.
Delivery times are usually:

  • Within the EU: 5–8 working days

  • Switzerland, Liechtenstein, Norway, UK: 7–10 working days

The actual delivery time may vary slightly depending on production volume and shipping provider.
Delivery delays due to force majeure, strikes or delivery difficulties at Printful do not justify a claim for damages.

5. Payment

The following payment options are available in the online shop:

  • Shopify Payments (credit card, Apple Pay, Google Pay)

  • PayPal

  • Other payment methods according to current shop information

Payment is made immediately upon completion of the order.

6. Retention of title

The goods remain the property of the seller until full payment has been received.

7. Right of withdrawal

Since the offered products are individually manufactured to order ( print-on-demand ), there is no right of withdrawal according to § 18 para. 1 no. 3 FAGG.
Returns are therefore only possible in the case of faulty or damaged goods .

In case of a complaint, the seller can be contacted at shop@dark-divas.com to contact.
Defective products will be replaced or credited after inspection.

8. Warranty

The statutory warranty provisions apply.
In the case of justified defects, a replacement or repair will be provided.
Further claims, in particular for damages, are excluded unless there is intent or gross negligence.

9. Liability

The seller is liable without limitation only for damages resulting from injury to life, body or health, as well as for damages based on intentional or grossly negligent conduct.
The seller is only liable for slight negligence in the event of a breach of essential contractual obligations (“cardinal obligations”).

10. Copyright

All images, texts and designs used in the online shop are protected by copyright and may not be used without express permission.

11. Applicable Law and Jurisdiction

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
For consumers , the place of jurisdiction is their place of residence; for entrepreneurs, Feldkirch (Austria) is the exclusive place of jurisdiction.

12. Final Provisions

Should individual provisions of these terms and conditions be invalid, the validity of the remaining provisions shall remain unaffected.
